    Deficient Dismissal Processes Can Yield Different Results

    Two recent cases highlight the discretion the Fair Work Commission has in determining whether an aggrieved worker’s unfair dismissal application will be successful.

    In both cases, the dismissal processes adopted by the employers were considered flawed. However, whereas as one employee was found to have been validly dismissed, the other was reinstated.
